O R D E R

This Writ Petition has been filed for a direction forbearing the 2nd respondent from passing orders for cancellation of patta in respect of 1/6

petitioner's land in Survey No.21/3 bearing patta No.1771 in Nehru Nagar, Dalavaihalli Village Panchayat, Nallampalli Taluk, Dharmapuri District pursuant to enquiry summon in Na.Ka.No.5943/ 2025 A3 dated 24.09.2025 pending disposal of suit in O.S. No.111 of 2025 on the file of the District Munsif Court, Dharmapuri.

2. Heard the learned counsel appearing on either side and perused the materials available on record.

3. The petitioner was issued patta in respect of the subject land. It is objected by the respondents 5 to 9 herein since the subject land is classified as Government Poramboke land and the same is required for public purpose. Therefore, respondents 5 to 9 submitted a representation before the 3rd respondent seeking cancellation of the patta issued in favour of the petitioner in respect of the subject land. Upon receipt of the said representation, the 3rd respondent conducted an enquiry and submitted his report to the 2nd respondent. Based on the said report, the 2nd respondent issued summons to the petitioner and respondents 5 to 9 for conducting an enquiry. Now, the petitioner sought for a direction forbearing the 2nd respondent from passing orders for cancellation of patta in respect of the subject land on the ground that the the patta in respect of the subject land 2/6

was issued in favour of the petitioner. That apart, the petitioner also filed a suit in OS.No.111 on the file of the District Munsif Court, Dharmapuri for injunction against the respondents 5 to 9 herein and also obtained interim injunction.

4. Admittedly, the petitioner filed only an injunction suit and it has nothing to do with the proceedings which is pending before the 2nd respondent regarding cancellation of patta. In fact, admittedly, the subject land is classified as Government Poramboke land. Therefore, the petitioner ought to agitated her grievance before the 2nd respondent. The mere pendency of the suit does not preclude the 2nd respondent from determining whether the petitioner is entitled to a patta or whether the subject land is Government Poramboke land.

5. In view of the above discussion, this Court is not inclined to entertain the prayer sought for by the petitioner. Accordingly, this Writ Petition stands dismissed. The 2nd respondent is directed to complete the enquiry and dispose of the representation submitted by respondents 5 to 9, dated 28.06.2025, on merits and in accordance with law, within a period of 8 weeks from the date of receipt of a copy of this order. No costs. 3/6
