ORDER
This Suo Motu Case is dealt with in an extraordinary manner by the Dedicated Bench, pursuant to Suo Motu.W.P.(Crl.) No.618 of 2025. 2.The case was registered in Cr.No.201 of 2020 dated 11.07.2020 for the alleged offence under Sections 279, 337 and 304(A) of IPC and Section 122 of MV Act. It is stated that a claim petition has been filed on behalf of the dependants of the victim and the claim has also been awarded. Therefore, they have no objection for the case being closed. It is stated that the accused is from Assam and he has been attending the case regularly and he is also willing to admit the case. However, there is a difficulty in getting the report from the Probationary Officer for accused as all his documents are related to the Assam State. Considering the factual matrix, context of the case, the antecedents of the accused, the nature of difficulty of the accused in attending the case all the way from Assam regularly, I am of the view that the benefit can be granted to the accused. It is evident that even if the accused is brought to face trial, it would impinge upon his right to a speedy trial. Due to the passage of time, a meaningful trial is unlikely, and no useful purpose would be served.

Accordingly, the case in CC.No.113 of 2020 on the file of the Judicial Magistrate Court, Thiruvottiyur Taluk, Tiruvallur shall stand quashed and this Suo Motu Transfer Case stand disposed of. 29.10.2025 ssa electronically alone. The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary. Further, the Court below is directed to dispatch the copy of this order to all concerned.
