ORDER

The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 8(c), 20(b)(ii)(B), 29(1) and 25 of the NDPS Act, 1985, Crime No.294 of 2024 on the file of the respondent Police, seeks anticipatory bail.

2. The allegation against the petitioner is that the petitioner/A3 and the Police party intervened A1, from him recovered 1.350 grams of Ganja and after arresting him, it revealed that he further involved in transporting, sale of ganja along with other accused. On the basis of his confession A2 was arrested and from him 350 grams of Ganja recovered. Further it revealed that this petitioner also involved in the occurrence, the petitioner's bike was also utilized for the purpose of transporting of ganja.

3. The learned counsel for the petitioner submitted that the petitioner is implicated based on the confession of A1 & A2, who were already arrested and released on bail and he prays for anticipatory bail. 2/4

4. The learned Government Advocate (Crl.Side) appearing for the respondent police reported that the petitioner is ranked as A3 and the investigation is not completed. Totally 1.350 kgs of ganja also recovered. Hence, he opposed to grant anticipatory bail to the petitioner.

5. Considering the fact that the petitioner is involved in transporting of ganja and if the petitioner is granted anticipatory bail, he would engage in the similar offence, I am not inclined to grant anticipatory bail to the petitioner.
