This Habeas Corpus Petition was filed under Article 226 of the Constitution of India to direct the respondents 1 to 3 to produce the corpus of the petitioners son, namely, Vijay Anand S/o Nallasamy, aged 33 years, before this Court and set him at liberty from the illegal custody of the 4th respondent. This Habeas Corpus Petition has been filed by the father of the detenu to direct the respondents 1 to 3 to produce his son, viz.,Vijay Anand S/o Nallasamy, aged 33 years, before this Court and set him at liberty from the illegal custody of the 4th respondent.
2. We have heard the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor appearing for the respondents 1 to 3.
3. Learned Additional Public Prosecutor would state that even on earlier occasion, the detenu absconded and the Police found that he went away from home on his own volition. Now again, a complaint has been filed in the year 2018.
4. Learned counsel for the petitioner would state that in this regard, a latest representation has been sent to the respondent police on 30.09.2025, but
till date no action has been taken.
5. On perusal of the records, it is seen that that, for the representation dated 30.09.2025, there is no acknowledgment filed by the petitioner. Even on earlier occasion, the detenu was missing and the police found that he went away on his own accord. We are not inclined to entertain this Habeas Corpus Petition.
