The petitioner, who was arrested and remanded to judicial custody on 05.08.2025, for the offences punishable under Sections 294(B), 323, 307, 506(ii) of I.P.C in connection with the S.C.No.461 of 2024, in Crime No. 52 of 2022, registered on the file of the respondent police, seeks bail. 2.

The case of the prosecution is that on 27.01.2022, the de-facto complainant lodged a complaint before the respondent police due to which the petitioner was arrested on 28.01.2022. Later, the petitioner was enlarged on bail in Crl.M.P.No.1421 of 2022 dated 19.04.2022. The trial has been commenced in S.C.No.461 of 2024 and on 10.10.2024, the petitioner failed to appear before the trial Court. Hence, Non-Bailable Warrant has been issued against this petitioner and arrested on 05.08.2025. Hence, the case. 3.

The learned counsel appearing for the petitioner submitted that he was unable to appear before the trial Court since 10.12.2024 due to the petitioner facing the life threat of other sides of the petitioner in the bonafide reason and if he enlarged on bail by this Court, he will co-operate the trial proceedings without fail. He further submitted that the petitioner is ready to abide by any conditions that may be imposed by this Court and sought for bail to the petitioner.

The learned Government Advocate (Criminal Side) appearing 2/4

for the respondent police while opposing the bail to the petitioner, reiterated the prosecution case. He further submitted that if the petitioner being a history sheeter, if released on bail, he will likely commit further commences and ten previous cases are pending against the petitioner. 5.

Considering the facts, grave nature of offence and taking note of the fact that the trial is pending, due to non co-operation of this petitioner, this Court is not inclined to grant bail to the petitioner. 6.

Accordingly, this Criminal Original Petition is dismissed. 13.10.2025 nvi To
