ORDER

The petitioner/A2, who apprehends arrest at the hands of the respondent police for the offences punishable under Section 4(1)(c) and 4(1- A)(ii) of TNP Act, in Crime No.588 of 2024, on the file of the respondent police, seek anticipatory bail.

2. Learned counsel appearing for the petitioner submitted that this is the second anticipatory bail petition and the earlier petition was dismissed by this Court vide order dated 22.11.2024. He further submitted that the petitioner is innocent and he has been falsely implicated in this https://www.mhc.tn.gov.in/judis

case and he is ready to abide by any stringent condition that may be imposed by this Court. Hence, he prayed for grant of anticipatory bail to the petitioner.

3. The case of the prosecution as putforth by the learned Government Advocate (Crl.Side) appearing for the respondent police, while opposing for grant of anticipatory bail to the petitioner, is that the petitioner, along with the other accused, was found to be in illegal possession of 12 unsealed brandy and on checking the bottles, it was found that some poisonous substance has been added in the said bottles. He further submitted that there are eleven previous cases pending against the petitioner which are similar in nature. 4.Heard the learned counsel for the petitioner and the learned Government Advocate (Crl.side) for the respondent and perused the materials available on record. 5.Considering the gravity of offence committed by the accused and that the bad antecedents of the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner, at this stage.
