ORDER

The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Section 303(2) and 326(b) of BNS Act, in Crime No. 610 of 2025, on the file of the respondent Police, seek anticipatory bail.

2. The case of the prosecution is that based on the secret information, the respondent police went to the scene of occurrence and found that the petitioner had illegally quarried 1⁄4 unit of river sand and transported in a Ashok Leyland Dost vehicle. Hence, the case.

3. The learned counsel for the petitioner submitted that this is the second anticipatory bail petition filed by the petitioner. He further submitted that the earlier petition was dismissed on the ground that the petitioner has 8 previous cases against him. Hence, he prayed to grant anticipatory bail to the petitioner.

4. The learned Government Advocate (Criminal side) for the respondent police, submitted that the petitioner had involved in illegal transportation of 1⁄4 unit of river sand. Hence, he opposed to grant anticipatory bail to the petitioners.

5. Considering the facts and circumstances of the case, nature of allegations, and the submissions made by learned counsels on either side, considering the fact that the petitioner had allegedly indulged in illegal 2/4

quarrying activities causing damage to the ecology and river bed, this Court is not inclined to grant anticipatory bail to the petitioner.
