ORDER

The petitioner, who was arrested and remanded to judicial custody on 15.08.2025, for the offences punishable under Sections 329 (4), 296(b), 118(1), 109, 311, 351(3) of BNS Act in Crime.No. 317 of 2025 on the file of respondent police, seeks bail.

The case of the prosecution is that due to monetary dispute, the petitioner along with 2 other accused persons trespassed into the house of the defacto complainant while she was alone in the house and robbed one thali saradu and two bangles at knife point. It is also alleged that A1 stabbed her indiscriminately by using knife due to which, she sustained injuries. Hence, the case.

3. Learned counsel appearing for the petitioner submitted that the petitioner is a sick person and is suffering from tuberculosis. He also submitted that the petitioner is no way connected with the alleged offence however, he is suffering incarceration from 15.08.2025. He further submitted that the petitioner is ready to abide by any stringent condition that may be imposed by this Court. Hence, he prayed for grant of bail to the petitioner.

The learned Government Advocate (Criminal side) for the respondent police, reiterated the prosecution case and submits that this is second bail application and the earlier bail application was dismissed by this Court in Crl.O.P.No.25530 of 2025 dated 17.09.2025. He further submitted that there are totally three accused in this case and this petitioner is arrayed as A2. He submits that the petitioner along with other accused persons trespassed into the house of the defacto complainant and attacked her with knife. He also submits that seven previous cases were pending against the petitioner out of which 3 cases under section 307 of IPC. Hence, he strongly opposed to grant bail to the petitioner.

5. This Court dismissed the earlier application filed by the petitioner in Crl.O.P.No.25530 of 2025 dated 17.09.2025 on the following reasons: " 5. Considering the above facts and circumstances of the case , taking note of the submission made by the learned Government Advocate (Criminal Side), considering the fact that the petitioner along with other accused persons trespassed into the house of the defacto complainant and assaulted the victim repeatedly with knife and caused severe injuries to her, this Court is not inclined to grant bail to the petitioner.

Accordingly, this criminal original petition stands dismissed."

Considering the above facts and circumstances of the case , taking note of the submission made by the learned Government Advocate (Criminal Side), nd bail application and there is no change of considering the fact that this is a 2 circumstances in this case, this Court is not inclined to grant bail to the petitioner.
