ORDER

Apprehending arrest in connection with Crime No.1379 of 2024 registered for the offences punishable under Sections 8(c) r/w and

20(b)(ii)(c) of the Narcotic Drugs and Psychotropic Substances Act r/w 25(1) (A) of Arms Act, the present petition has been filed seeking anticipatory bail.

The case of the prosecution is that on 15.11.2024 the petitioner and other accused were found in illegal possession of 24.950 kilograms of Ganja by the respondent police. Hence, the case. 3.

The learned counsel for the petitioner submitted that the petitioner is an innocent and that she has been falsely implicated in this case. A1 is the husband of the petitioner and he along with two other accused have been arrested and remanded to judicial custody. 4.

The case of the prosecution as put forth by the learned Government Advocate (Crl. Side) appearing for the respondent Police, opposing for grant of anticipatory bail, is that the petitioner is the wife of A1. The petitioner is a part of the gang who have been continuously selling ganja in the locality. The petitioner has got four previous cases out of which two cases are registered for the offence under NDPS Act. He further submitted that custodial interrogation of the petitioner is very

much required since the contraband is of a commercial quantity. Hence the learned Government Advocate (Crl.side) vehemently objected for granting anticipatory bail to the petitioner.

5. Considering the fact and circumstances of the case, the nature of the allegation and the fact that the petitioner has got two previous cases of similar nature pending against her, this Court is not inclined to grant anticipatory bail to the petitioner.
