Apprehending arrest in connection with Crime No.416 of 2024 registered for the offences punishable under Sections 406, 420, 294(b) and 506(2) of IPC, the present petition has been filed seeking anticipatory bail.
2. Pleading innocence on the part of the petitioner, false implication in the case, learned counsel for the petitioner seeks indulgence of this court. He would further submit that the petitioner is ready to abide by any stringent condition that may be imposed by this Court.
3. The case of the prosecution as putforth by the learned Government Advocate (Criminal Side) appearing for the respondent police, opposing for grant of anticipatory bail, is that, the defacto complainant is the owner of 5 cars and she has given the cars for business purpose to the petitioner. He would submit that the petitioner has neither paid the rental amount nor returned the car, whereas, he has disposed the cars to third parties and the value of the car is worth about more than Rs.20 lakhs. He would further submit that one car has been returned and remaining cars have not yet been returned.
4. Heard the learned counsel for the petitioner, the learned Government Advocate (Criminal Side) for the respondent Police and perused the materials available on record, considering the facts and the submissions and the cars are not yet recovered, this court is not inclined to grant anticipatory bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed. 24.01.2025 dsn
