O R D E R

This Criminal Original Petition has been filed to quash the proceedings against the petitioners in FIR No.342 of 2025, on the file of the respondent Police.

2. The learned counsel for the petitioners would submit that on account of civil dispute between the families of the petitioners and the second respondent / defacto complainant, a false case has been given. She would submit that the proceedings are nothing but an abuse of process of law.

3. The learned Government Advocate (Crl. Side) would submit that it is a case where the petitioners trespassed into the house of the de facto complainant, assaulted the de facto complainant and her husband and vandalized the articles inside the house. The de facto complainant and her husband have also suffered injuries. He would further submit that the petition is in the initial stage of investigation.

4. The learned counsel for the de facto complainant would submit that though there are civil disputes pending between the parties, the 2/4

petitioners have trespassed into the house of the de facto complainant and after assaulting the de facto complainant and her husband, had also caused severe damage to the articles and the victims were also injured and took treatment in a hospital.

5. This Court carefully considered the submissions made by the learned counsel appearing for the parties and perused the materials placed on record.

6. A perusal of the F.I.R. discloses a commission of Cognizable offences warranting investigation by the respondent Police. The investigation is in progress and the final report is yet to be filed. The Hon'ble Supreme Court in the State of Haryana and Ors. Vs. Ch.Bhajan lal and Ors. reported in 1992 AIR 604 has held that the inherent powers under Section 482 of the Criminal Procedure Code are to be exercised sparingly with great caution and only cases where allegations made in F.I.R., do not prima facie constitute any offence or manifestly attended with malafides, can be quashed. This Court has further cautioned that the powers under Section 482 of Criminal Procedure Code should not be used to stifle the legitimate investigation.

7. In view of the same, this Criminal Original Petition stands dismissed as premature. It is made clear that this Court has not expressed any opinion on the merits of the case and all contentions of the petitioners are left open to be raised at the appropriate stage. Consequently, connected miscellaneous petition is closed.
