O R D E R

This writ petition has been filed seeking for issue of a writ of mandamus directing the first respondent to issue separate patta to the petitioner with respect to the subject property by considering the representation made by the petitioner on 26.08.2025.

2. Heard the learned counsel for the petitioner and the learned Government Advocate for the first respondent.

3. The petitioner is claiming right and title over the subject property by virtue of a registered sale deed dated 05.12.2002. The petitioner submitted an online application on 01.07.2025 seeking for subdivision of patta and for transfer of patta in her name. According to the petitioner, the second respondent was making a claim as if the joint patta issued in favour of the petitioner was carrying a wrong survey number. Pursuant to the same, the first respondent inspected and went through the revenue records and it was confirmed that the petitioner has 2/4

purchased S.No.678/1 by virtue of the registered sale deed. The Revenue Divisional Officer, vide proceedings dated 17.07.2025 acted upon the report submitted by the first respondent and dismissed the claim made by the second respondent. According to the petitioner, this order has become final. Pursuant to the above, the petitioner wanted to settle the subject property in favour of her son but the concerned Sub-Registrar seems to have refused to entertain the document on the ground that the separate patta does not stand in the name of the petitioner. Hence, the petitioner made the representation dated 26.08.2025 to the first respondent to issue separate patta in her name. Since the same was not considered, the present writ petition has been filed before this Court.

Taking into consideration the facts and circumstances of the case and materials placed before this Court, there shall be a direction to the first respondent to act upon the online application submitted by the petitioner on 01.07.2025 and take a decision on its own merits and in accordance with law, within a period of six weeks from the date of receipt of a copy of this order.
