PRAYER : Petition filed under Article 226 of the Constitution of India praying for the issuance of a Writ of Mandamus directing the Respondents to consider and dispose of the petitioner's representations dated 15.04.2025 for correction of date of birth as 28.03.1999 instead of 28.03.2000 in the 10th and 12th standard mark sheets, college grade sheets and transfer certificate. O R D E R
This Writ Petition has been filed seeking a direction to the respondents to consider and dispose of the petitioner's representations dated 15.04.2025 for correction of date of birth as 28.03.1999 instead of 28.03.2000 in the 10th and 12th standard mark sheets, college grade sheets and transfer certificate.
2. Mr.S.Mythreye Chandran, learned Special Government Pleader takes notice on behalf of the respondents. Since no adverse orders are being passed against respondents 2, 3 & 4, notice to respondents is dispensed with.
3. It is the case of the petitioner that his date of birth has been wrongly entered as 28.03.2000 instead of 28.03.1999 at the time of admission in the 2nd respondent school as well as the 4th respondent college which has got reflected in his college semester grade sheets and transfer certificate dated 26.06.2021. In order to rectify the said error, the petitioner made a representation dated 2/5
15.04.2025 to all the respondents along with necessary documents. Despite receipt of the same, no action has been taken by the respondents till date. Aggrieved by which, the petitioner has come up with the present Writ Petition.
4. Learned counsel appearing for the petitioner submitted that it would suffice if this Court issues a direction to the respondents to consider the petitioner's representation dated 15.04.2025 within the time frame that may be stipulated by this Court.
5. Learned Special Government Pleader appearing for the 1st respondent has no objections to the said order being passed.
6. In view of the limited relief sought for in this Writ Petition, this Court without expressing any opinion on the merits of the case, directs the petitioner to submit a copy of representation dated 15.04.2025 to the respondents enclosing documents in proof of age and date of birth within a period of two (2) weeks from the date of receipt of a copy of this order. Upon receipt of the same, the respondents are directed to consider the same on merits and in accordance with law and pass appropriate orders within a period of four (4) weeks thereafter.
7. This Writ Petition stands disposed of with the aforesaid direction. There shall be no order as to costs.
