ORDER

The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 8(c) and 20(b)(ii)(C) of Narcotic Drugs and Psychotropic Substances Act, 1985 in Crime No.600 of 2024, on the file of the respondent police, seeks anticipatory bail.

2. Learned counsel appearing for the petitioner would submit that the petitioner is innocent and has not committed any offence as alleged by the prosecution and he has been falsely implicated in this case. He further submitted that totally there are eight accused in this case and based on the confession statement given by A3, the petitioner/A5 and others were arrayed as accused and no recovery has been made from him and the petitioner is ready to produce solvent sureties and to abide by any stringent conditions that may be imposed by this Court, therefore, he prayed for grant of anticipatory bail to the petitioner. 3.Learned Government Advocate (Crl.

Side) appearing for the respondent police opposed for grant of anticipatory bail to the petitioner, stating that it is the case of recovery of commercial quantity of Ganja and A1 and A2 had in possession of 750 grams of Ganja and based on their confession, 20.200 kgs of Ganja was recovered from A3, who is under custody. The petitioner/A5 is the retail seller and he had involved in three previous cases, in which, one under NDPS Act, another under Arms Act and the other one under Section 381 IPC.

4. Heard the learned counsel for the petitioner, the learned Government Advocate (Crl. Side) appearing for the respondent police and perused the materials available on record including the FIR.

5.Considering the submissions made by the learned Government Advocate (Criminal side)

and taking note of the fact that the petitioner had also involved in yet another NDPS Act case and also in the present case, the quantity involved is commercial, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, this criminal original petition is dismissed.
