4. Narasimman Petitioner(s) Vs The State rep by Inspector of Police Vandavasi North Police Station, Tiruvannamalai District. Crime No.300 of 2012 Respondent(s) PRAYER Criminal Original Petition filed under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023, to enlarge the petitioners on bail in S.C.No.198 of 2019 on the file of the Additional District Court (FTC), Arani, Tiruvannamalai District.
For Petitioner(s):
Mr.D.Magesh For Respondent(s):
Mr.A.Gopinath Government Advocate (Crl.Side)
ORDER
The petitioners seek bail in S.C.No.198 of 2019 in Crime No.300 of 2012 pending on the file of the learned Additional District Court (FTC), Arani, Tiruvannamalai District for the offence punishable under Sections 120B, 147, 148, 201, 302, 364 of IPC.
2.The allegation against the petitioners is that they were earlier arrested and released on bail for a murder case, but subsequently jumped bail en masse on 10 th March 2025. They were arrested on 4 th September 2025 after execution of a Non-Bailable Warrant.
3.The learned counsel for the petitioner submitted that the petitioners had regularly appeared earlier, were arrested within a short period, and are willing to abide by stringent conditions and co-operate with the trial. Hence, the learned counsel prayed for bail to the petitioners.
4.The learned Government Advocate (Crl.side) for the respondent
reported that the petitioners absconded from 10 th March 2025 and were arrested only on 4 th September 2025. He submitted that there are six accused in this case, and the petitioners are ranked as A1 to A4 and they are chronic defaulters, causing delays in the trial process. Hence, he vehemently opposed for the grant of bail to the petitioners.
5.I have also gone through the orders passed by the learned Sessions Judge, it is clear the petitioners absconded from 10 th March 2025, avoiding the trial process. Considering their six-month absence and hindrance to trial progress, I am not inclined to grant bail and accordingly this Criminal Original Petition is dismissed.
