Mr.A.Gopinath Government Advocate (Crl.Side) COMMON ORDER The petitioners apprehend arrest for the alleged offence under Sections 303(2) of BNS 2023, 21(1) Mines and Minerals (Development and Regulation) Act, 1957 in Crime No.186 of 2025, on the file of the respondent police seek anticipatory bail.
2. The allegation against the petitioners is that they joined hands with other accused, illegally quarried river sand from Thenpennai river. Hence, the complaint.
3. The learned counsel for the petitioners submitted that the quantity found to be transported is very minimum and the petitioners are not having any previous cases and prays to grant anticipatory bail to the petitioners.
4. The learned Government Advocate (Crl.Side) appearing for the respondent police, reported that totally 4 bullock carts were used and all the vehicles were involved illegally quarrying the sand in Thenpennai river. Hence, he opposed to grant anticipatory bail to the petitioners.
5. I have considered the submissions and perused the records. The petitioners are involved in illegally quarrying the sand from Thenpennai river but also they were involved in damaging the ecology. Though the argument of the petitioner was impressed to the extent that they were involved in taking a very small quantity of sand, but, it is the fact that continuously persons like him are illegally quarrying the river sand, and they indulge in unlawful activity together. If anticipatory bail is granted to the petitioners, they will indulge in
similar activities and the Thenpennsai river is the lifeline of various districts, hence, this Court is not inclined to grant anticipatory bail to the petitioners. 6.Accordingly, this Criminal Original Petition is closed. 14-10-2025 Mpa Index:Yes/No Speaking/Non-speaking order Internet:Yes To 1.The Judicial Magistrate-I, Villupuram.
