ORDER

The petitioner, who was arrested and remanded to judicial custody on 25.08.2025, for the offence punishable under Sections 126(2), 296(b), 309(4), 311, 324(4), 125 & 351(3) of BNS, in Crime No.95 of 2025, registered on the file of the respondent, seeks bail.

2.The case of the prosecution is that the petitioner along with the other accused robbed money from the petitioner's shop, assaulted and abused him in filthy language. Hence, the case.

3.The petitioner is involved in offences under Sections 126(2), 296(b), 309(4), 311, 324(4), 125 & 351(3) of BNS, in Crime No.95 of 2025. He was granted bail by the learned Principal District and Sessions Judge in Crl MP No.4183 of 2025 dated 14.05.2025, with a condition to appear before the respondent police, which he failed to comply with, leading to cancellation of bail and his subsequent arrest.

4.The learned counsel for the petitioner submitted that the petitioner is innocent and he has not committed any offence as alleged. The petitioner is in judicial custody from 25.08.2025 and the investigation has been completed and

the final report has also been filed. Hence, the learned counsel prayed for grant of bail to the petitioner.

5.The learned Government Advocate (Crl. Side) appearing for the respondent police opposed the grant of bail to the petitioner and submitted that this petitioner is a habitual offender and history-sheeter with 20 cases against him, most of which are of a similar nature. He further submitted that even during pendency of earlier trials, the petitioner has indulged in similar offences and if released on bail, there is every possibility of recurrence of crime.

6. Considering the fact that the investigation has been completed and the final report filed and also the apprehension that if the petitioner released on bail he may indulge in similar offences, this Court is not inclined to grant bail to the petitioner. Hence, this Criminal Original Petition stands dismissed. 14-10-2025 gbi
