Writ Petition filed under Article 226 of the Constitution of India seeking issuance of a Writ of Mandamus, directing the 2nd respondent herein to consider and pass orders on the petitioner's representation dated 09.06.2024 submitted for splitting Joint Pattas bearing numbers 3662 and 3663 issued in favour of the Respondents 3 to 9 herein for the properties in Survey No. 111/15 (27 Ares) and Survey No.167/2 (8 cents) of Nambedu Village and issue a separate patta in favour of the petitioner for the entire property to an extent of 27 cents in Survey No.111/15, 8 Cents in Survey No. 167/2, 7 Cents in Survey No. 167/1, 4 cents in Survey No. 168/2 17 cents in Survey No. 168/3A1, 6 cents in Survey No. 168/3A2 of Nambedu Village, Vandavasi Taluk, Thiruvannamalai District.

This writ petition has been filed seeking for issue of a writ of mandamus directing the second respondent to deal with the representation made by the petitioner on 09.06.2024, wherein the petitioner has sought for splitting up joint pattas and issue separate patta in favour of the petitioner with respect to the subject property.
2. Heard the learned counsel for the petitioner and the learned Government Advocate for the respondents 1 and 2.
3. The case of the petitioner is that the property was originally purchased by the petitioner's grandfather. The petitioner's grandfather executed a Will dated 20.01.2010 in favour of the petitioner in respect of the subject property. Thereafter, the petitioner applied for patta. However, the Revenue authorities instead of issuing separate patta, issued joint patta in Patta Nos.3662 and 3663 for various survey numbers.

In view of the above, the petitioner made a representation dated 09.06.2024 seeking for issuance of separate patta in the name of the petitioner with respect to the subject property based on the Will executed by the petitioner's grandfather. Since the same was not considered, the present writ petition came to be filed before this Court.

Taking into consideration the facts and circumstances of the case and considering the materials placed before this Court, there shall be a direction to the second respondent to deal with the representation made by the petitioner on 09.06.2024 on its own merits and in accordance with law and pass final orders, after giving an opportunity of hearing to the petitioner, within a period of eight weeks from the date of receipt of a copy of this order. Since there are other interested parties, they shall also be given an opportunity before passing final orders. The Writ Petition is disposed of. There shall be no order as to costs.
