ORDER

The petitioner, who was arrested and remanded to judicial custody on 16.08.2025, for the offences punishable under Sections 296(b), 115(2), 118(1), 109(1) of BNS and Section 25(1B)(a) of Arms Act in Crime No.206 of 2025, registered on the file of the respondent police, seeks bail. 2.

The case of the prosecution is that the petitioner is the father-in-law of the defacto complainant; that on 02.06.2025, the petitioner under the influence of intoxication abused his wife in filthy words and assaulted her with hands; that while the defacto complainant intervened, the petitioner abused her, took a country made gun and shot her with an intention to kill her; that thereby, the defacto complainant and her son, who sat on the lap of the defacto complainant sustained multiple injuries. Hence, this case. 3.

The learned counsel appearing for the petitioner submitted that on account of family dispute, the petitioner has been falsely implicated in this case and he is in judicial custody since 16.08.2025. He further submitted that the petitioner had kept a country made gun in his shed, which he obtained from Kollimalai and the petitioner is ready to abide by any conditions that may be

imposed by this Court and sought for bail to the petitioner. 4.

The learned Government Advocate (Criminal Side) appearing for the respondent while opposing the bail to the petitioner, reiterated the prosecution case and states that there are totally three victims injured in this case, out of which, the male child of the defacto complainant sustained grievous injuries; and that the investigation is pending. He further submitted that this is second bail application and the earlier application was dismissed by this Court in Crl.O.P.No.26455 of 2025 dated 25.09.2025.

5. This Court dismissed the earlier application filed by the petitioner in Crl.O.P.No.26455 of 2025 dated 25.09.2025 on the following grounds: "5. Considering the facts and circumstances of this case, grave nature of offence, the fact that three victims were shot by this petitioner using a country made gun and the fact that investigation is pending, this Court is not inclined to grant bail to the petitioner.

Accordingly, this criminal original petition stands dismissed."

6. Considering the fact that the investigation is still pending and there is no change in circumstances, This Court is no inclined to grant bail to the petitioner.
