..Respondent Prayer: Writ Petition is filed under Article 226 of the Constitution of India for issuance of a Writ of Certiorarified Mandamus to call for the records of the respondent relating to order in Lr.Rc.No.29893/PA/I.(3)/2003 dated 29.08.2003, quash the same and issue directions to the respondent to grant interest at 18% per annum for the delayed payment of Pensionary benefits.

ORDER
Writ Petition has been filed to call for the records of the respondent relating to order in Lr.Re.No.29893/PA/I.(3)/ 2003 dated 29.08.2003, quash the same and issue directions to the respondent to grant interest at 18% per annum for the delayed payment of Pensionary benefits.
2. The petitioner is an employee of the respondent/Tamil Nadu Khadi & Village Industries Board. After retirement, the retirement benefits were paid to all the persons by way of instalments. Every person's pensionary benefit amount was paid in lumpsum. Thereafter, it is found by the petitioner that the lumpsum amount was not an appropriate amount. Thereafter, the respondent ordered for recovering the pensionary amount which has been already paid in lumpsum. Aggrieved by the said recovery order, the petitioner has come before this court by way of the present writ petition.
3. Learned counsel for the respondent would submit that the pensionary benefit amount entitled by the petitioner which was already paid was an appropriate amount and there is no need to proceed the recovery proceedings.

4. The above statement of the learned counsel for the respondent is recorded and in view of the above, I finds nothing survive for adjudication in the writ petition.
