This petition has been filed by the petitioner to condone the delay of 1026 days in paying the deficit court fee of Rs.4,900/- in the above appeal.

2. The learned counsel appearing for the petitioner would submit that as the appeal papers returned for compliance have been misplaced, they were not able to comply in time.

Hence, there was a delay and the same is neither willful nor wanton.

3, Considering the nature of averments made in the affidavit filed along with this petition, this petition is Ordered.
