ORDER

This Writ Petition has been filed by the petitioner seeking for a Writ of Mandamus, to direct the respondent to consider the representation dated 11.09.2025 made by the petitioner for return of all the original parent Page No.1 of 4

documents pertaining to the property sold in auction along with duly cancelled Memorandum of Deposit of Title Deeds to the petitioner.

2. Mr.Arun Babu, learned counsel, accepts notice on behalf of the respondent. In view of the consent expressed by the parties, this writ petition is taken up for final disposal at the stage of admission itself.

3. The petitioner purchased the subject property from the respondent under the provisions of Securitisation and Reconstrution of Financial Assets and Enforcement of Security Interest Act, 2002 by paying the entire sale consideration. Pursuant to the sale, a sale certificate was duly issued in his favour and when he tried to register the sale certificate, he was demanded to produce the entire parent documents of the subject property. Therefore, on 11.09.2025, he made a representation before the respondent requesting the cancellation of the mortgage and the return of all original parent documents to enable him to proceed with the registration. Since the same was not considered, the petitioner has filed the present writ petition before this Court for appropriate orders.

4. Though very many grounds have been raised in this writ petition, Page No.2 of 4

learned counsel appearing for the petitioner submits that, it would suffice, if this Court issues a direction to the respondent to consider the petitioner's representation, dated 11.09.2025 and pass appropriate orders, within a time frame that may be fixed by this Court.

5. The learned counsel appearing for the respondent submitted that the entire document is available in T.No.542/2023 on the file of DRT, Chennai. Hence, on instructions, he submitted that appropriate steps will be taken and original documents will be given to the petitioner as expeditiously as possible.

6. In view of the above, this Court directs the respondent to furnish all the original documents to the petitioner, within a period of twelve (12) weeks from the date of receipt of a copy of this order, if there is no legal impediment.
