ORDER
(The order of the Court was made by Mrs.Justice J.Nisha Banu,J.) This petition has been filed to condone the delay of 101 days in filing the Cross Objection in CMA.No.2012 of 2024.
2. Learned counsel for the claimant would state that till date the award ordered on 28.11.2023 by the Court below has not been honoured.
3. Learned counsel for the Insurance Company would state that he had filed the Cross Objection along with the condone delay petition, questioning the quantum passed by the Court below and the same is in SR stage.

vsi submissions made by either side, the delay is condoned on condition that the petitioner/appellant shall deposit the entire award amount along with accrued interest as on today to the credit of MCOP.No.1846 of 2020 on the file of Motor Accidents Claims Tribunal, II Judge, Court of Small Causes, Chennai, on or before 24.02.2025. On such deposit being made, the respondent/claimant is permitted to withdraw 50% of the amount deposited along with accrued interest. The balance amount along with accrued interest shall be deposited in a fixed deposit scheme, initially for a period of three years, to be renewed periodically.
3. It is made clear that if the above conditional order is not complied with, the condone delay petition stands dismissed automatically without reference to this Court. If the conditional order is complied with, the condone delay petition is allowed and the Registry is directed to number the Cross Objection, if it is otherwise is order. Post the matter on 25.02.2025.
