This case is taken up for settlement before the National Lok Adalat. Both the parties are present. M/s.R.Sree Vidhya, learned counsel for appellant and Mr.Yuvaraj, learned counsel for the first respondent are
present. After mutual discussion, negotiation, mediation and conciliation between both parties, they arrived at a compromise to settle the matter as follows:
TERMS OF SETTLEMENT The Insurance Company is on appeal, challenging the award of Rs.5,25,196/- passed by the learned Additional Sub-Judge (Motor Accidents Claim Tribunal), Ponneri, in M.C.O.P.No.08 of 2022 dated 28.06.2024.
2. After negotiations, the parties have now arrived at Rs.3,00,000/- (Rupees Three Lakhs Only) together with interest at 7.5% per annum from the date of petition. The appellant seeks six weeks time to deposit the award amount of Rs.3,00,000/- together with interest as indicated above and less the amount, if any, already paid.
3. The appellant/Insurance Company is directed to deposit the above modified award amount of Rs.3,00,000/- (Rupees Three Lakhs Only) with interest as indicated above, within a period of six weeks from the date of receipt of a copy of this award.
4. On such deposit, the claimant/first respondent is permitted to withdraw the amount without filing any formal petition. Award is passed
accordingly.
5. The Tribunal is directed to transfer the amount through RTGS/NEFT to the parties concerned on proper identification in accordance with the terms of the award, without insisting on any formal permission petition. The Civil Miscellaneous Appeal is disposed of accordingly. The connected miscellaneous petition is closed, if any.
