Respondent Prayer : Writ Petition filed under Article 226 of Constitution of India praying for the issuance of a Writ of Mandamus, directing the respondent to pay the amount to him in respect of the 90 days of Earned Leave surrendered by him along with 9 % interest from the date of respective accrual until the date of payment of the respondent for the amount within the stipulated period to be fixed by this Court.

ORDER

This Writ Petition has been filed seeking a direction to the respondent to disburse the amount payable towards encashment of 90 days of Earned Leave surrendered by the petitioner prior to his retirement, along with applicable interest.

2. Heard the learned counsel appearing on either side and perused the materials available on record.

3. The petitioner had worked in the Tamil Nadu State Transport Corporation and retired from service on 31.05.2018. However, he was not paid the encashment of 90 days of surrendered Earned Leave Salary to the tune of Rs.70,217.50/-. Though the petitioner made several representations, the same were not considered so far.

4. Considering the facts and circumstances of the case, the

respondent is directed to disburse the Earned Leave Salary for 90 days surrendered by the petitioner prior to his retirement, along with interest at the rate of 6% per annum, within a period of twelve weeks from the date of receipt of a copy of this order.

5. With the above direction, this Writ Petition stands disposed of. No costs.
