ORDER
The petitioner has filed the present writ petition seeking issuance of writ of mandamus to direct the second respondent to consider the petitioner's representation dated 12.08.2025.
2. I have heard the learned counsel for the petitioner and the learned counsel for the respondents/the Tamil Nadu Waqf Board .

It is brought to my notice by the learned counsel for the petitioner that the enquiry is to be conducted tomorrow i.e., on 01.11.2025 and a notice has been issued on 22.10.2025 by the Chief Executive Officer, Tamil Nadu Waqf Board viz., the second respondent herein. The grievance of the petitioner is that the enquiry is being conducted at the instance of the third party and the petitioner who has valid objections, is not given a hearing. The petitioner, in this regard has already given a representation on 12.08.2025 and the writ petition has been filed for the limited relief of seeking a 2/4
direction to consider the said representation dated 12.08.2025.

The learned counsel for the respondents, on instructions state that the Chief Executive Officer, Tamil Nadu Waqf Board is going to refer the matter to the Board and the respondents have also no objection for the petitioner also participating in the enquiry and submitting his claim/objection if any, including documents in support of the claims/objection of the writ petitioner.
5. In the light of the above, this Writ Petition is disposed of with a direction to the second respondent to allow the petitioner to participate in the enquiry proceedings tomorrow i.e., on 01.11.2025 at 4.00 p.m. as communicated in Na.Ka.No.3568/24/AA23/Kovai, dated 22.10.2025, the petitioner's representation along with the claims that the petitioner proposes to make at the hearing shall also be considered in accordance with law and on merits, before any further decision is taken by the second respondent. Since the enquiry is stated to be conducted tomorrow i.e., on 01.11.2025, the learned for the respondents/Wakf Board shall inform the second respondent 3/4
P.B.BALAJI.J., about the order passed by this Court permitting the petitioner to participate the enquiry. No costs.
