This application has been filed to reopen the plaintiff's side further evidence for examination of the third plaintiff as P.W.2 in the above suit.

2. The learned counsel for the respondent seeks time to file counter.

3. It appears that the evidence has already been closed and the matter is ripe for arguments. At this stage, the applicants / plaintiffs have come out with this application to reopen their evidence for the purpose of examining the third plaintiff as P.W.2. Since this delayed initiative taken by the applicants / plaintiffs causes unnecessary delay and inconvenience to the respondent / defendant, I feel this application may allowed on the condition that the applicant shall pay a sum of Rs.1,500/- as cost to the respondent / defendant.

4. The learned counsel for the applicants / defendants paid a sum of Rs.1,500/- directly to the learned counsel for the respondent who is present in the Court. The learned counsel for the respondent has also acknowledged the same.

5. Since the cost is paid directly to the learned counsel for the respondent / defendant by the learned counsel for the applicants / plaintiffs, this application is allowed.
