This Criminal Revision Petition has been filed to to set aside the order passed on 24.03.2025 by the Court of Magalir Neethi Mandram ( Fast Track Mahila Court), Tiruvallur in Crl.M.P.No. 11069 of 2021 in 1/5

S.C.No.258 of 2016 and pass orders.

The case of the prosecution case is that the petitioner stands accused of murdering his mother, Jothi Praba on 23.06.2016 at around 7..00 p.m. The prosecution alleges that the petitioner, who was residing with his paralyzed and bedridden mother, verbally abused her in filthy language carried her to an open well located opposite their residence, and pushed her into it. He allegedly jumped in afterward ad attempted to drown her. While her mother died in the incident, the petitioner was rescued by the fire department and local residents. Based on these events a complaint was lodged by the defacto complainant, DR.Usha who is the petitioner's stepsister. With regard to the same a case was filed in S.C.No.258 of 2016.

3. The petitioner herein has filed a Crl.M.P.No. 11069 of 2021 to discharge the accused from the charges u/s 341 and 302 of IPC pending in S.C.No.258 of 2016 and the same was dismissed on 24.03.2025 . Challenging the same the present petition came to be filed.

4. The main grounds raised by the petitioner is that he is suffering from bipolar disorder and Schizophrenia and the petitioner has drastic 2/5

changes in his mood and behaviour, whenever he stops his medication and should be rushed to hospital on emergency basis and the said condition is said to prevail throughout his entire life time which makes him incapable of face trial.

On a perusal of the impugned order this Court has observed that the petitioner was referred to the Institute of Mental Health to asses the mental capacity of the petitioner and has received the observation report from the Institute of Mental Health and as per the said report dated 05.03.2025, the petitioner was admitted on 12.02.2025 and is taking his medication regularly and he was discharged on 29.02.2025 and further stated that the petitioner is aware of the charges against him, he is oriented to time,place, person and he is able to guide his counsel and he is fit to stand trial.

6. In view of the above, it is made clear that the learned Judge has referred the petitioner to a Mental Health center and assessed his mental health and obtained a report and thereafter passed the impugned order which is perfectly valid in the eye of law and the same cannot interfered with.

7. For the foregoing reasons, this Criminal Revision Petition stands dismissed. However, the petitioner is at liberty to agitate all his defence during trial.
