Respondents in both WPs PRAYER in WP.No.24996/2002:- Writ petition filed under Article 226 of the Constitution of India prays to issue a Writ of Certiorari, calling for the records of the respondents in the notice issued under Section 222 of the Chennai City Municipal Corporation Act dated 26.06.2002, received by the petitioner on 03.07.2002 and quash the same.
PRAYER in WP.No.17168/2002:- Writ petition filed under Article 226 of the Constitution of India prays to issue a Writ of Certiorari, calling for the records of the 1st respondent in letter bearing Ni.Ma.U.Thu. Na.Ka.No.LE4/1149/82 dated 06.05.2002, quash the same and consequently direct the respondents to consider the continuance of the lease in favour of the petitioner, originally granted to the petitioner's late father, in respect of land situate at No.41, Elephant Gate Bridge Road, Chennai 600 112 in R.S.No.1267/1 of Vepery Village. For Petitioner in both WPs : No appearance For Respondents in both WPs : Mr.V.C.Selvasekaran COMMON ORDER [Order of the Court was made by M.SATHYANARAYANAN.,J] The writ petitions are filed for the relief to call for the records relating to the notices dated 06.05.2002 and 26.06.2002 issued by the respondentCorporation and to quash the same. The writ petitions were admitted on 21.05.2002 and 12.07.2002 respectively. Interim orders were also granted.
2. The matters were listed before the Hon'ble First Bench on various occasions and also before another Bench and all those times, the cases were adjourned. When the matter was listed on 17.07.2017, before this Court, the learned counsel appearing for the petitioner prayed for some accommodation to get instructions on account of long lapse of time, from the date of admission of the writ petitions. Therefore, the matter was directed to be listed on 07.08.2017 finally.
3. When the matter was called on 06.11.2017, the learned counsel for the petitioner would submit that despite the notice sent to the petitioner herein, calling upon him to give instructions to proceed further in the matter, he has not responded and also filed a memo dated 08.08.2017 reporting "No instructions from the petitioner".
4. The name of the petitioner is also printed in the cause-list and there is no representation on his behalf. Therefore, the writ petitions are dismissed for default and interim orders granted in W.P.M.P.Nos.34301 of 2002 and 23312/2002 stand vacated and miscellaneous petitions are closed. No Costs.
