Respondents Prayer : Writ Petition is filed under Article 226 of the Constitution of India praying to issue a Writ of Certiorarified Mandamus, calling for the records on the file of the 1st respondent herein in Na.Ka. No.30561/2016/M3 dated 19.02.2019 issued by the 1st respondent herein and the suspension order 1/5
issued by the 2nd respondent herein in Na.Ka.No.30561/2016/M3 dated 28.11.2016, quash the same and to issue consequential directions to the 1st and 2nd respondents herein to reinstate the petitioner in service with all service and monetary benefits.

ORDER
This Writ Petition has been filed challenging the orders dated 19.02.2019 and 28.11.2016, thereby suspended the petitioner from service.
2. Heard the learned counsel appearing on either side and perused the materials available on record.

The petitioner, while he was working as Panchayat Secretary in the year 2011, is alleged to have demanded a sum of Rs.1,000/- from one M.Isac Murugan as illegal gratification for issuing the final installment amount for construction of a house under Green House Scheme. In this connection, an FIR in Crime No.3 of 2016 dated 24.11.2016 was registered on the file of the Vigilance and Anti Corruption, Krishnagiri. Thereafter, a 2/5
trap was organized on 24.11.2016, in which the petitioner was caught redhanded. He was subsequently arrested and remanded to judicial custody. After completion of investigation, a final report was filed and the same was taken cognizance in Spl.C.C.No.2 of 2019 on the file of the Chief Judicial Magistrate, Krishnagiri. By Judgment dated 02.03.2025, the petitioner was acquitted of all charges. Based on the order of acquittal passed by the Criminal Court, the petitioner has now challenged the order of suspension.
4. On instructions, the learned Special Government Pleader appearing for the respondents submitted that now the Government has now passed an order in G.O.Ms.No.81, Human Resources Management (N) Department, dated 04.08.2022, for considering the cases of prolonged suspension.
5. In view of the above, the petitioner is directed to submit a representation seeking revocation of the suspension order to the first respondent within a period of two weeks from the date of receipt of a copy of this order. On receipt of such representation, the first respondent is 3/5
directed to consider and dispose of the same, in the light of the G.O.Ms.No.81, Human Resources Management (N) Department, dated 04.08.2022, within a period of four weeks thereafter.
6. With the above direction, this Writ Petition stands disposed of. Consequently, connected miscellaneous petitions are closed. There shall be no order as to costs.
