ORDER
This Suo Motu Case is dealt with in an extraordinary manner by the Dedicated Bench, pursuant to Suo Motu.W.P.(Crl.) No.618 of 2025.
2. This case in Cr.No.264 of 2021 is registered for alleged offences under Section 294(b) of IPC and under Section 4 of TNPHW Act. In this case, the defacto complainant is reported to be at Delhi. In spite of service of summons, he has not come forward to give evidence and the accused has been attending the case regularly and there is no previous or subsequent case as against the accused.

Considering the factual matrix, context of the case, antecedents of the accused, any further continuance of case would impinge upon his right to a speedy trial. Due to the passage of time, a meaningful trial is unlikely, and no useful purpose would be served.

Accordingly, the proceedings in S.T.C.No.680 of 2022 on the file of Judicial Magistrate No.1, Bhavani Taluk, Erode is quashed and this Suo Motu Transfer Case is disposed of.
10.10.2025 veda electronically alone. The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary. Further, the Court below is directed to dispatch the copy of this order to all concerned.
