Prayer:- Writ Petition filed under Article 226 of the Constitution of India seeking a Writ of Mandamus, directing the 1st respondent to consider the representation dated 02.12.2024 and release the Petitioner, N.Jayakumar S/o.Narendra Kumar, Life Convict No.2420, aged about 51 years, now confined in Central Prison-I, Puzhal, as per the order dated 28.10.2024 passed by this Court in WP.No.26102 of 2024 and direct the respondent to consider the eligibility for premature release under G.O.Ms No.430, Home (Prison IV) Department dated 11.08.2023.

O R D E R

(Order of the Court was made by P.VELMURUGAN J.) This writ petition has been filed seeking a direction to the first respondent to consider the representation dated 02.12.2024, wherein the petitioner, N.Jayakumar, S/o.Narendra Kumar, Life Convict No.2420, aged about 51 years, presently confined in Central Prison-I, Puzhal, has sought premature release as per the order dated 28.10.2024 passed by this Court in W.P.No.26102 of 2024, and consequently to direct the respondents to

consider his eligibility for premature release in accordance with G.O.Ms No.430, Home (Prison IV) Department dated 11.08.2023.

The learned counsel for the petitioner submitted that the petitioner, a life convict had earlier submitted a representation dated 06.11.2023 seeking premature release under the Advisory Board Scheme and Sections 432 and 433 Cr.P.C and the same was rejected. Aggrieved thereby, the petitioner filed a writ petition in W.P.No.26102 of 2024, which was disposed by this Court by order dated 28.10.2024, granting liberty to the petitioner to submit a fresh application seeking premature release under G.O.Ms.No.430, Home (Prison -IV) Department, dated 11.08.2023 and directing the respondents to consider the same with reference to the terms and conditions under the said scheme and to pass appropriate orders as expeditiously as possible, preferably within a period of four weeks. Pursuant thereto, the petitioner submitted a fresh representation on 02.12.2024 under the said G.O, which remains pending.

3. The learned counsel further submitted that the petitioner has already undergone more than 27 years of imprisonment as a life convict without any

adverse remarks, and therefore, prayed that this Court may issue a direction to the first respondent to consider the petitioner's representation.

4. The learned Additional Public Prosecutor appearing for the respondents submitted that earlier representation submitted by the petitioner seeking premature release was rejected based on the report of the advisory board. He further submitted that the petitioner has now submitted a fresh representation under G.O.Ms.No.430, Home (Prison-IV) Department dated 11.08.2023, and that the same is presently under consideration.

5. In view of the limited prayer sought for in this writ petition, this writ petition is disposed of directing the respondents to consider the representation of the petitioner dated 02.12.2024 on its own merits and to pass appropriate orders as expeditiously as possible.
