Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus directing the respondents to consider the petitioner's representation dated 12.03.2025 and thereby direct the respondents to cancel the allotment issued infavour of the non eligible candidates i.e., non SC people/Government employees and to reconvey the land in Survey No.17/4A, 18/1, 18/2 and 18/3 to an extent of 1.39 acres of Ammaiyappa Nallur Village, Uthiramerur Taluk, Kancheepuram District to the petitioner on the light of Harijan Welfare Scheme, 1978.

ORDER

The relief sought for in this writ petition is to direct the respondents to consider the petitioner's representation dated 12.03.2025 and thereby direct the respondents to cancel the allotment issued in favour of the non eligible candidates i.e., non SC people/Government 2/7

employees and to re-convey the land in Survey No.17/4A, 18/1, 18/2 and 18/3 to an extent of 1.39 acres of Ammaiyappa Nallur Village, Uthiramerur Taluk, Kancheepuram District to the petitioner on the light of Harijan Welfare Scheme, 1978.

2. Mrs.S.Indhu Bala, learned Additional Government Pleader takes notice on behalf of the respondents. By consent of both the parties, this writ petition is taken up for final hearing at the admission stage itself.

The case of the petitioner is that the lands comprised in S.Nos.17/4A, 18/1, 2 & 3 measuring an extent of 1.39 acres at Ammaiyappa Nallur Village, Uthiramerur Taluk, Kancheepuram District belongs to petitioner's father and the said lands were acquired by the first respondent for the purpose of providing housing site landless poor Harijans under Tamil Nadu Acquisition of Land for Harijan Welfare Schemes Act, 1978. However, till date the said lands were unutilized by the beneficiaries of the aforesaid scheme. The fact remains that the beneficiaries of the Scheme are mostly belongs to Backward Class and individuals holding immovable assets and Government Jobs. Therefore, 3/7

the petitioner sent a representation dated 12.03.2025 to the respondent, seeking to allot the aforesaid land in favour of the eligible candidates i.e., landless people, who are comes under the Harijan Welfare Scheme and requested to cancel the allotment issued in favour of the non eligible candidates i.e., non SC people/Government employees. However, the said representation was not considered, till date. Hence, the petitioner has come forward with the present writ petition.

4. Though many grounds have been raised in this writ petition, learned counsel for the petitioner submitted that, it would suffice, if this Court issues direction to the respondents to consider the petitioner's representation dated 12.03.2025.

5. Learned Additional Government Pleader appearing for the respondents submitted that the petitioner's representation dated 12.03.2025 would be considered and appropriate orders passed, within a time frame that may be fixed by this Court.

6. Heard the learned counsel on either side and perused the 4/7

materials available on record.

Considering the limited relief sought for by the learned counsel for the petitioner, this Court without going into the merits of the case, directs the respondents to consider the petitioner's representation dated 12.03.2025 and pass appropriate orders on merits and in accordance with law, within a period of four weeks from the date of receipt of a copy of this order.

With the aforesaid direction, this writ petition is disposed of. No costs.
