ORDER
This transfer civil miscellaneous petition has been filed to withdraw the case in O.P.No.269 of 2025 on the file of the Family Court, Namakkal and transfer the same to the file of the Family Court, Coimbatore. 2.Heard learned counsel for the petitioner and perused the materials available on record.
3.Despite name printed in the cause list, there is no representation on the side of the respondent.
4.Learned counsel for the petitioner submits that the respondent filed a divorce petition in O.P.No.269 of 2025 before the Family Court, Namakkal. The petitioner is residing at Coimbatore and working as an Assistant Professor in a Private College, Coimbatore. The distance between the petitioner's residence and the Family Court, Namakkal is more than 150 kms and it is very difficult for her to attend each and every hearing before the Family Court, Namakkal. He further submits that the petitioner being constantly threatened and intimidated by the respondent and his supporters and the same does not allow the petitioner to take active participation in the above case. Therefore, he prays to transfer the case to the Family Court, Coimbatore.
5.I have gone through the affidavit filed in support of the transfer petition as well. I find merit in the submissions made by the learned counsel for the petitioner.
6.Considering the facts and circumstances of the case and the submissions made by the learned counsel for the petitioner, this Court is inclined to transfer the case on the file of the Family Court, Namakkal to the file of the Family Court, Coimbatore. Accordingly, the case in O.P.No.269 of 2025 is hereby withdrawn from the file of the Family Court, Namakkal and transferred to the file of the Family Court, Coimbatore. After receipt of the case papers from the Family Court, Namakkal, the Family Court, Coimbatore is directed to send a notice to the respondent within two weeks. After due service of notice, the Family Court, Coimbatore is directed to proceed with the matter in the manner known to law.
7.With the above directions, this transfer civil miscellaneous petition is allowed. No costs. Consequently, connected civil miscellaneous petition is closed.
8.Considering the nature of avocations of both the parties, this Court is inclined to permit both the parties to appear through the Video Conferencing
mode before the Family Court, Coimbatore. However, it is made clear that both the parties shall appear before the Family Court, Coimbatore as and when required.
