This writ petition has been filed for the issue of a writ of mandamus directing the 2 nd respondent to act upon the representation made by the petitioner on 01.07.2024, wherein, the petitioner is seeking for grant of sub-division of patta in S.No.310/2, Ulagapuram Village, Thenmugam, Vellode Post, Perundurai Taluk, Erode District.
2. Heard both sides and perused the materials available on record.
3. The case of the petitioner is that he is the owner of the subject property by virtue of a partition decree dated 19.03.1997 that was passed in O.S.No.40/1997. The Revenue Department made re-survey and the property was sub-divided and allotted survey No.310/2. Hence, the petitioner was issued with a joint patta. It is under these circumstances, the petitioner submitted a representation before the nd respondent seeking for the sub-division and for the issuance of sub-division patta. Even though the representation was received by the 2 nd respondent and summons was issued, there was no progress in the enquiry. It is under these circumstances, the present writ petition has been filed. 2/4

Taking into consideration the facts and circumstances of the case and considering the materials placed before this Court, there shall be a direction to the nd respondent to deal with the representation made by the petitioner on 01.07.2024 on its own merits and in accordance with law and take a decision within a period of six weeks from the date of receipt of a copy of this order. If there are any other interested persons, they shall also be given an opportunity before the orders are passed.
