Prayer : Petition filed under Article 226 of the Constitution of India seeking a writ of Certiorarified Mandamus calling for the records relating to the sale notice dated 23.09.2025 in Ref. COCHN/ARM II/SN25-26/04 issued by respondent under the SARFAESI Act and quash the same as being illegal, arbitrary, violative of the SARFAESI Act and Rules.

(Order of the Court was made by the Hon'ble Chief Justice) Challenge to the legality and validity of the sale notice is repelled, as, petitioners have an alternative efficacious remedy before the Debts Recovery Tribunal. There are no exceptional grounds raised in the petition which would warrant indulgence of writ Court, without exhaustion of alternative remedy.

2. Petition is dismissed with liberty to approach the Debts Recovery Tribunal. W.M.P.No.44045 of 2025 filed seeking to permit

petitioners to file single writ petition is allowed subject to payment of separate court fee within two weeks. Other interim application is also dismissed.
