ORDER

The petitioners, who were arrested and remanded to judicial custody on 21.09.2025, for the offences punishable under Sections 126(2), 296(b), 109, 309(4) & 351(3) of BNS Act (Sections 341, 294(b), 307, 392 & 506(II) of IPC), in Crime No.146 of 2025, registered on the file of the respondent police, seek bail.

2.The case of the prosecution is that the petitioners waylaid the defacto complainant and robbed a sum of Rs.1,900/- from him. Hence, the case. 3.The learned counsel for the petitioners submitted that they have been falsely implicated due to previous cases, are not connected to the crime, the property has been recovered, and they have been in judicial custody from 21.09.2025. He further submitted that the petitioners are willing to co-operate with the investigation and abide by any conditions, seeking bail. 4.The learned Government Advocate (Crl.Side) for the respondent reported that on 20.09.2025, the petitioners waylaid the defacto complainant,

demanded money, and robbed Rs.1,900/- at knife point. He further submitted that the 1 st petitioner is having 12 previous cases, 2 nd petitioner is having 4 previous cases and the 3 rd petitioner is having 5 previous cases and the investigation is pending. Hence, he opposed for grant of bail to the petitioners.

5. Considering the gravity of the offence, the petitioners' bad antecedent, and the ongoing investigation, releasing them on bail may lead to absconding, evidence tampering, or hindering the investigation.
