India to issue a Writ of Mandamus directing the respondents to consider the dispose of the petitioners representation dated 26.05.2025 based on the RTI reply dated 21.05.2025 and to initiate Suo-Motu Proceedings under Section 34 of the Tamil Nadu Hindu Religious and Charitable Endowments Act, 1959 to declare the sale as void ab initio, restore the property to the temple records and present any further alienation or encumbrance of the said temple land within a time frame to be fixed by this Court.

This writ petition has been filed seeking a writ of mandamus to direct the respondents to dispose of the petitioner's representation dated 26.05.2025.

2. Heard the learned counsel for the petitioner and the learned Additional Government Pleader appearing for the respondents.

3. The petitioner, after obtaining information under the provisions 2/5

of the Right to Information Act, has brought to the notice of the respondents that the property belonging to the temple has been alienated without following the mandate of Section 34 of the Tamil Nadu Hindu Religious and Charitable Endowments (HR & CE) Act, 1959. The petitioner has, therefore, given a representation dated 26.05.2025 directing the respondents to take effective steps against the unlawful alienation of the temple property. The petitioner's grievance is that the authorities have not passed any orders on his representation despite the lapse of 6 months. Hence, the petitioner has been constrained to file this writ petition.

The learned Additional Government Pleader appearing for the respondents would submit that the petitioner's representation has already been forwarded by the 2nd respondent to the 3rd respondent on 30.06.2025 and that the 3rd respondent will take appropriate steps to dispose of the petitioner's representation regarding the protection of the temple's property.

In the light of the above, this writ petition is disposed of, directing the 3rd respondent to take effective steps to dispose of the petitioner's representation dated 26.05.2025 on merits and in accordance with law and to pass final orders within a period of eight weeks from the date of receipt of a copy of this order.
