O R D E R

The petitioner, who was surrendered and remanded to judicial custody on 14.08.2025 for the alleged offence under Sections 420, 506(1) of IPC Act subsequently alter the Section 406, 409, 417 of IPC in Crime No.160 of 2024 on the file of the respondent police, seeks bail. 1/6

The case of the prosecution is that A1 represented to the defacto complainant and others that she would purchase gold coins for lower price, induced them to pay Rs.1,02,31,700/- by bank transfer and thereafter neither paid nor handed over the gold coins and thus committed the aforesaid offences.

3. The learned counsel for the petitioner submitted that the petitioner is ranked as A6. The co-accused was granted bail by this Court in Crl.O.P.No.8970 of 2025, based on which, earlier anticipatory bail was granted to the petitioner on condition that she would deposit a sum of Rs.2,00,000/- (Rupees two lakhs only) to the credit of Crime No.160 of 2024. However, she was not able to comply with the condition and subsequently, she surrendered before the District Munsif Cum Judicial Magistrate, Ranipet District and was remanded in Judicial custody from 14.08.2025. Hence, she prayed for grant of bail.

4. The learned Government Advocate (Crl Side) submitted that the investigation was completed and final report was also filed and the same has been taken cognizance in C.C.No. 211 of 2025.

5. Heard both sides and perused the materials available on record. 2/6

6. Considering the nature of allegations, period of incarceration and the fact that the petitioner is being a lady and also that investigation was completed and final report was filed, this Court is inclined to grant bail to the petitioner with certain conditions.

7. Accordingly, the petitioner is ordered to be released on bail on his executing a bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties, for a like sum to the satisfaction of the learned District Munsif Judicial Magistrate, Ranipet and on further conditions that:

[a] the sureties shall affix their photographs and Left Thumb Impression in the Application for Surety ship [Judicial Form No.46 annexed to 'The Criminal Rules of Practice, 2019']. The learned Magistrate shall obtain a copy of any one of the identity proofs to ensure their identity;

[b] the petitioner shall report before the trial Court at 10.30 a.m., for a period of three weeks and thereafter, as and when required for interrogation; [c] On breach of any of the aforementioned conditions, the learned Magistrate/Trial Court is entitled to pass appropriate orders against the petitioner in accordance with law as if the aforementioned conditions 3/6

have been imposed and the petitioner released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)13 SCC 283];

[d] If the accused thereafter absconds, a fresh FIR can be registered under Section 269 of B.N.S. 14.10.2025 kmm Note :
