ORDER

This writ petition has been filed to direct the respondent to pay enhanced compensation as per judgement in A.S.No.134/2016 for petitioner's acquired land, based on the petitioners' representation dated 04.03.2023, 17.02.2025 and 31.05.2025 respectively and also considering the petitioners' representation dated 19.09.2025.

2. Mr.P.Sathish, learned Additional Government Pleader, takes notice on behalf of the respondent.

3. By consent of the parties, the main writ petition is taken up for disposal at the admission stage itself.

4. The learned counsel for the petitioner would submit that in this case, the petitioner's land was acquired by the Tamil Nadu Government under the Tamil Nadu Highways Act, 2001. However, the compensation was not paid by the respondent. Hence, an appeal in AS.No.184 of 2016 was filed by the petitioner for enhancement of compensation and the same was partly allowed vide order dated 04.11.2022. In spite of the same, the compensation was not paid by the respondent till date. In this regard, the representations dated 04.03.2023, 17.02.2025, 31.05.2025 and 19.09.2025 were made by the petitioner. However, the said representations were not considered by the respondent till date. Hence, this writ petition.

In reply, the learned Additional Government Pleader appearing for the respondent would submit that the petitioner's representation dated 04.03.2023 was forwarded to the Special Tahsildhar by the District Collector on 12.04.2023 and he seeks 4 weeks time to dispose of the said representations. Hence, he requested this Court to pass appropriate orders.

6. Heard the learned counsel for the petitioner and the learned Additional Government Pleader appearing for the respondent and also perused the entire materials available on record.

7. In the case on hand, the petitioner's land was acquired by the Tamil Nadu Government under the Tamil Nadu Highways Act, 2001. However, the compensation was not paid by the respondent. Hence, an appeal in AS.No.184 of 2016 was filed by the petitioner for enhancement of compensation and the same was partly allowed vide order dated 04.11.2022. In spite of the same, the compensation was not paid by the respondent till date. In this regard, the representations dated 04.03.2023, 17.02.2025, 31.05.2025 and 19.09.2025 were made by the petitioner. However, the said representations were not considered by the respondent till date.

8. In view of the above, this Court directs the respondent to consider and dispose of the petitioner's representation dated 04.03.2023 4/6

and also the subsequent representations dated 17.02.2025, 31.05.2025 and 19.09.2025 on merits and in accordance with law, within a period of 4 weeks from the date of receipt of a copy of this order.

9. With the above direction, this writ petition is disposed of. No cost.
