ORDER
The petitioner, who was arrested and remanded to judicial custody on 30.08.2025, for the offences punishable under Section 296(b), 126(2), 115(2), 310(2) and 351(3) of BNS in Crime No.137 of 2025, registered on the file of the
respondent police, seeks bail.
2. The case of the prosecution is that on August 27, 2025, the defacto complainant was waylaid, robbed and assaulted by the petitioner along with 5 others, snatched cell phone, ATM card, and gold ring and stabbed him in the right eye. Hence, the case.
3. The learned Counsel for the petitioner submits that the petitioner is an innocent person and he has been falsely implicated in this case. He further submit that the petitioner is no way connected with the alleged offence. He also submits that the petitioner has been suffering incarceration from 30.08.2025. Hence, he prays for grant of bail to the petitioner.
4. The learned Government Advocate (Crl. Side) appearing for the respondent police submits that there are totally six accused involved in this case and the petitioner herein has been ranked as A6 and the stolen property was recovered and though petitioner is not having any previous cases, the investigation in this case has not yet been completed. Hence, he has serious
objection to release the petitioner/accused on bail. 5.Heard both sides and perused the materials available on record. 6.Considering the facts and circumstances of the case, the overtact levelled against the petitioner and also considering the period of incarceration undergone by the petitioner from 30.08.2025, and no bad antecedent against him, this court is inclined to grant bail to the petitioner with certain conditions.

Accordingly, the petitioner is ordered to be released on bail on executing a bond for a sum of Rs.15,000/- (Rupees Fifteen Thousand Only) with two sureties, for a like sum to the satisfaction of the learned District Munsiff cum Judicial Magistrate, Neyveli and on further conditions that: [a] the sureties shall affix their photographs and Left Thumb Impression in the Application for Surety ship [Judicial Form No.46 annexed to 'The Criminal Rules of Practice, 2019']. The learned Magistrate shall obtain a copy of any one of the identity proofs to ensure their identity;
[b] the petitioner shall report before the respondent police daily at 10.30 a.m., for a period of two weeks;
[c] the petitioner shall not abscond either during investigation or trial;
[d] the petitioner shall not tamper with the evidence or witness either during investigation or trial; [e] On breach of any of the aforesaid conditions, the learned Magistrate/Trial Court is entitled to take appropriate action against the petitioner in accordance with law as if the conditions have been imposed and the petitioner released on bail by the learned Magistrate/Trial Court himself, as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)AIR SCW 5560];
[f] If the accused thereafter absconds, a fresh FIR can be registered under Section 269 B.N.S.
