This petition has been filed seeking to condone the delay of 1,226 days in filing the Civil Miscellaneous Appeal.
2. Mr.K.Vinod, learned counsel who takes notice on behalf of the 2nd respondent, vehemently opposes the condonation of delay. He has also filed a counter affidavit.
3. Though notice has been served on the 1st respondent and their name is printed in the cause list, none appears on their behalf.
4. The reasons adduced in the affidavit filed in support of this petition being satisfactory, this Civil Miscellaneous Petition is ordered and consequently, the delay of 1,226 days in filing the appeal is condoned, subject to the condition that the claimants/petitioners will not be entitled to any interest for the delay period i.e., for 1,226 days, in the appeal.
