ORDER

This Criminal Miscellaneous Petition has been filed to modify the condition imposed by this Court in Crl.R.C.No.1452 of 2023 dated 13.03.2025 in para 7 as follows :- "7. On such payment is being made, the Magistrate is directed to hand over interim custody of the vehicle to the petitioner after obtaining the original RC Book and appropriate undertaking from the petitioner that the petitioner will not alienate the vehicle or change the body, Engine number, Chasis number of the vehicle and that the petitioner would produce the vehicle as and when required either for trial or for confiscation"

2. The learned counsel for the petitioner submitted that the original RC book of the vehicle was deposited in Crime No.66 of 2020. Hence, she needs some more time to produce the xerox copy of RC book in anyone of the case. Accordingly, the present petition has been filed to modify the condition.

3. Considering the facts and circumstances and also considering the reasons stated by the petitioner in the petition seems to be justifiable, this Court is inclined to modify the condition that two weeks time is granted to the petitioner to deposit the sum ordered by this court as well as to produce the xerox copy of RC book in Crime No.57 of 2021 on the file of respondent police 2/4

from the date of receipt of copy of this order and he shall produce the said receipt for deposit of amount before the court below.

4. Except the above modification, the other conditions imposed by this Court in Crl.R.C.No.1452 of 2023 dated 13.03.2025 shall remain unalterted. 17-11-2025 Index:Yes/No Speaking/Non-speaking order Internet:Yes rpp To
