For Applicants S.Prem Auxilian Raj D.Saravanan A. Tamilvanan For Respondents:

Mr.K.Shanmugakhani

ORDER

I had recorded whatever transpired in court as it is. Mr.Prem Auxilian Raj does not dispute that when the order was dictated in open court, he was very much present and after hearing both sides, I recorded that the schedule of property in the previous suit is slightly different from the present suit.

2. Today, he urges that he did not have full instructions when the civil revision petition was taken up for hearing and he seeks to review the order.

3. An order of a Court is not a counter in the game of litigation for it to be changed each time, the petitioner or the respondent, comes up with new fact that had not been disclosed to the court. The order must have any error apparent on the face of record which is sine quo non for entertaining a petition

under Order XLVII of Code of Civil Procedure. If the petitioner is aggrieved by the order, his remedy is by way of Appeal. As I do not find any error in the order passed in the civil revision petition, the revision application is dismissed. No costs. The connected miscellaneous petition is also dismissed. 17-10-2025 ssk.
