M/s.P.Suresh Kumar For Respondent in both Crl.O.Ps Mr.A.Gopinath Government Advocate (Crl.Side) COMMON ORDER The petitioners, who were arrested and remanded to judicial custody on 25.09.2025, for the alleged offence punishable under Section 311 of BNS Act in Crime No.401 of 2025, on the file of the respondent police, seeks bail.
2. The allegation against the petitioners is that they joined hands with five other accused conspired and after selecting the target, they followed the defacto complainant, at knife point attacked him and taken away the cash worth about Rs.45.68 lakhs.
3.The learned counsel appearing for the petitioners submitted that the petitioners are only friends with one Pandi. The petitioner in Crl.O.P.No.28891 of 2025 is only known person from him and hailing from same place. Hence he has handed over the bike for the purpose of personal use of one Pandi and he was not aware about the occurrence. Similarly other petitioner has also been
falsely implicated in this case and he was not aware about the intention of A1/Pandi and prays to grant bail to the petitioners. 4.The learned Government Advocate (Crl.Side) appearing for the respondent police submitted that totally 7 accused in this case. The petitioners have been arrested and their statements were also recorded and it revealed that for the past one month, this petitioner joined hands with other accused involved in selecting the target and thereafter they also fixed the date and followed the defacto complainant and attacked him and taken away the cash. Hence, he opposed to grant bail to the petitioners.
5. Considering the nature of allegation and the fact that so far no money has been recovered and the main accused are still absconding, if bail is granted to the petitioners, at this stage would hamper investigation. Hence, I am not inclined to grant bail to the petitioners.
6. Accordingly, this Criminal Original Petition is dismissed. 24-10-2025 Mpa Index:Yes/No Speaking/Non-speaking order
