O R D E R

The Writ Miscellaneous Petition (Criminal) has been filed seeking to implead the petitioner herein as 5th respondent in W.P.Crl.No.864 of 2025. The contention of the learned counsel appearing for the petitioner is that the petitioner is an original borrower and that the SARFAESI proceedings have been initiated against her. He further submitted that the petitioner has filed an appeal before the Debts Recovery Tribunal and now the appeal is coming on 26.11.2025. Further, as per the order passed by the Tribunal, she had deposited the sale consideration. Now, he seeks to implead the petitioner herein as one of the respondents in the Writ Petition.

Considering the facts of the case that the petitioner has deposited the amount and the appeal is now pending, this Court is of the view that the presence of the petitioner is required in this case. Accordingly, the Writ 2/4

Miscellaneous Petition (Criminal) stands ordered. 4.

Registry is directed to carry out the necessary amendment in the Writ Petition (Criminal) No. 864 of 2025 and the list the case on 05.11.2025.
