ORDER

This Miscellaneous Petition has been filed to vacate the interim stay granted by this Court in WMP.No.3555 of 2025 in W.P.No.31760 of 2025 dated 26.08.2025.

2. The issue in the Writ Petition is whether Section 87 proceedings can be initiated against a non member. It is the claim of the petitioner that he is not a member of the Kallakurichi Agricultural Producers Cooperative Marketing Society.

3. A perusal of the order passed by this Court in CRP (NPD) No.1172 of 2021, in particular, paragraphs nos. 24 and 28 point out that the petitioner had participated in the auction only as an auction purchaser and not in the capacity as a member of the Society. Hence, it would require a detail probe into the matter. If the interim stay is vacated and the petitioner is proceeded against, it would cause irreparable prejudice. As prima facie, I am satisfied that initiation of 87 proceedings is bad, I am not inclined to vacate the interim stay. This Writ Miscellaneous Petition is dismissed. Interim stay already granted by this

Court in WMP.No.3555 of 2025 in W.P.No.31760 of 2025 on 26.08.2025 is made absolute.

Post the Writ Petition in the usual course.
