PRAYER : Criminal Original Petition filed under Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023, to enlarge the petitioner on anticipatory bail in the event of arrest in Crime No. 567 of 2025 pending investigation on the file of the respondent police.

O R D E R

The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 8(c) read with Section 1/6

20(b)(ii)(B) of the NDPS Act, 1985 in Crime No. 567 of 2025, on the file of the respondent Police, seeks anticipatory bail.

2. The allegation against the petitioner is that the petitioner along with other accused were in possession of 2.150 kilograms of Ganja illegally. The respondent police recovered the same from the petitioner/A2 and registered a case against the petitioner and others.

3. Learned counsel appearing for the petitioner submitted that the petitioner is innocent person and he has been falsely implicated in this case. He further submitted that the petitioner is ready to abide by any stringent condition that may be imposed by this Court. Hence, he prayed for grant of bail to the petitioner.

4.The learned Government Advocate (Criminal side) for the respondent police, reiterated the prosecution case and submits that the petitioner and other accused persons were in possession of 2.150 kilograms of Ganja illegally. He further submits that 2.150 kilograms have been recovered from the petitioner/A2 herein. Therefore, he strongly opposed for grant of 2/6

anticipatory bail to the petitioner.

Taking into the fact that the huge quantity of Ganja 2.150 have been recovered from the petitioner/A2 herein; that one previous case has been pending against the petitioner similar in nature; the gravity of offence committed by the petitioner/A2 herein and the investigation in this case is yet to be concluded, at this stage, this Court is not inclined to grant anticipatory bail to the petitioner.
