Prayer:- Writ petition filed under Article 226 of the Constitution of India praying for issuance of a writ of Certiorarified Mandamus, calling for the records of the respondent with respect to the order dated 18.09.2025 bearing No.CDN-16/ 2/ 2025-CDN-NMC passed by its and quash the same and consequently, direct the respondent to grant permission to the petitioner institute to undertake admission of 150 seats for the Academic 1/4

Year 2025-26 in pursuance to the application filed by the petitioners institute namely Chettinad Institute of Medical services vide application No.NMC/ UG/ 2025-26/ 000015.

O R D E R

This Writ Petition has been filed challenging the order passed by the respondent dated 18.09.2025 thereby dismissed the appeal preferred by the petitioner.

2. Heard the learned counsel appearing on either side and perused the materials available on record.

Though this Writ Petition has been filed challenging the order passed by the respondent dated 18.09.2025, an appeal remedy is available under Section 28(6) of the National Medical Commission Act, 2019 before the Appellate Authority as against the impugned order dated 18.09.2025. Accordingly, the petitioner has filed an appeal, which is now pending before the Appellate Authority.

4. In view of the availability of an effective appellate remedy to the petitioner, this Court is not inclined to entertain this Writ Petition. Accordingly, the Writ Petition stands dismissed with a direction to the Appellate Authority to dispose of the pending appeal within a period of 3 weeks from the date of receipt of a copy of this order. It is also made clear that the Appellate Authority shall permit the legal assistance to the petitioner in accordance with law. No costs. Consequently, the connected Miscellaneous Petitions are closed.
