Prayer : Writ Petition filed under Article 226 of Constitution of India praying to issue a Writ of Mandamus directing the respondents 3 to 5 to cancel the patta No.567 issued to the respondents 6 to 8 for our lands mearuing 1.24.50 hecatres, comprises in Survey No.177/2, and confirm the patta No.88 originally issued to the petitioners for the above lands, situated in Thazhthevanoor Village, Vzahapadi Post, Kalvarayan Hills Taluk, Kallakurichi District, which is in the petitioner's possession and enjoyment for more than 10 decades and pass orders. ORDER

This writ petition has been filed for issue of Writ of Mandamus directing the respondents 3 to 5 to cancel the patta issued in the name of respondents 6 to 8 and to issue patta in the name of the petitioner with respect to the subject property.

2, Heard Mr.T.Dhanasekaran, learned counsel appearing for the petitioner and Mr.C.Jayaprakash, learned Government Advocate appearing for the 2/5

respondents 1 to 5.

The case of the petitioner is that the property was originally owned by his grandmother and after her demise, he was in possession and enjoyment of the same and Patta No.88 was also issued in his name. During the UDR scheme, the revenue records were changed in the name of respondents 6 to 8, who did not have any right over the property. Hence, the petitioner submitted a representation to remove the names of the respondents 6 to 8 and to restore the patta in the name of the petitioner. Since the same was not considered, the present writ petition has been filed before this Court.

Taking into consideration the facts and circumstances of the case and considering the materials placed before this Court, there shall be a direction to the second respondent to deal with the representation made by the petitioner on 29.05.2025, after affording opportunity to respondents 6 to 8 and final orders shall be passed on its own merits and in accordance with law, within a period of eight weeks from the date of receipt of a copy of this order. 3/5
